Forwarders Liability Insurance
The forwarders liability insurance deals with claims arising from loss and/or damage, which carriers, forwarding and warehousing companies, agents and logistics enterprises may be exposed to due to their various contractual obligations towards their principals. A liability for logistic performances may be given based on national or international law, standard business terms and conditions or individual contractual agreements, often to an extent not consciously known to an enterprise before accepting a business deal. Logistic enterprises are liable for damage caused by their own employees or agents during transport of goods, handling of same and/or organization of the shipment (e.g. during storage at the warehouse). For most logistic businessmen this goes without saying. However, it is also still incomprehensible for many that they might also be faced with claims caused by third parties, not directly instructed by them, and possibly also by agents and sub-contractors instructed in turn by said third party enterprises. The worst scenario is to be “stuck” with the claim amount of an unsuccessful recourse carried out against one of these third parties. The aforementioned sub-instructed enterprises don’t necessarily have to appear in the classical form of sub-contractors or agents, but may also be international NVOs, crane operators and/or port authorities.
This sort of risk coverage by a forwarder’s liability insurance is obligatory because:

This sort of risk coverage by a forwarder’s liability insurance is obligatory because:
- according to sec. 7 a GÜKG every carrier must have such insurance cover, provided he professionally effects nongratuitous national transports with vehicles over a maximum allowable weight of 3,5 to.
- according to no. 29 ADSp it is mandatory for all forwarding agents and warehousing companies if they want to base their business terms and conditions on the privileges of said ADSp and
- such cover should be standard for every logistic enterprise in order to protect his own financial statements, taking a possible total loss scenario into consideration.
